Divorce is a formal dissolution of a marriage. Married couples must have been separated for at least 12 months before being able to file for a divorce. If your marriage lasted less than 2 years you generally need to have been to marriage counselling before you can file for a divorce, and in either case there should be no likelihood of you reconciling the relationship with your former partner when you file for a divorce.
Australian Law (Family Law Act 1975) operates under the ‘No-Fault’ principle meaning that when granting a divorce there is no need to prove who was at fault for the marriage breakdown. The court simply needs to be satisfied that you have been living separately for at least one year and there is no likelihood of getting back together in order to grant your divorce.

Divorce and Property Settlement
Divorce is sometimes the last thing to be finalised after a separation (breakdown in the marital relationship). The divorce itself simply formalises the end of the marriage and does not determine the issues of the children’s living arrangements, property settlement or financial support. These issues can be finalised at any point after separation, however any application for property settlement must be made within 12 months from the date of the divorce being granted. It is still possible to apply for a property settlement after this date but only in special circumstances which our Lawyers can advise you on.
